This Terms of Use Agreement ("Agreement") is between True Care Behavior, a Colorado-based provider of in-home Applied Behavior Analysis (ABA) services ("we," "us," or "our"), and the individual or entity ("you" or "your") who accesses or uses our website, communication platforms, or related services (collectively, the "Services").
By accessing or using our Services in any way, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree to all terms, you should not use our Services.
We may update this Agreement from time to time. It is your responsibility to review this page periodically. Continued use of our Services constitutes acceptance of any changes.

I. Description of Services
True Care Behavior provides general information about autism and related developmental disorders, information about in-home ABA therapy services in Colorado, scheduling and intake coordination, insurance eligibility verification, and communication regarding treatment and care coordination.
All educational content on our website is for informational purposes only.

II. Your Use of the Services
A. Eligibility and Authority
By using our Services, you represent and warrant that you are at least 18 years old, you have the legal authority to enter into this Agreement, you are a parent, guardian, or authorized representative if submitting information about a minor, and you are not restricted by law from using these Services.
B. Accuracy of Information

You agree not to use the Services for unlawful purposes, interfere with website security or functionality, attempt to gain unauthorized access to accounts or systems, upload malicious software or code, collect personal information from other users, use automated tools to scrape or crawl the website, or harass, threaten, or misuse communication systems.
We reserve the right to investigate and take legal action for unauthorized use.

III. SMS Communications
If you consent to receive text messages from True Care Behavior, you may receive appointment reminders, scheduling updates, and care coordination communications. Message frequency may vary. Standard message and data rates may apply.

IV. Payments
A. Website Access
There is no charge to access our website or submit service inquiries.
B. ABA Services
Fees for ABA therapy services are established separately through service agreements and insurance authorizations. We may utilize third-party billing or payment platforms. Any disputes related to payment processing must be addressed directly with the applicable third-party provider.

V. Disclaimers and Limitation of Liability
A. Informational Content Only

B. No Warranties
All Services are provided "as is" and "as available." VII. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any dispute arising from this Agreement shall be resolved in Denver County, Colorado. You waive objections based on venue or jurisdiction.

VIII. Arbitration
Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration administered by the American Arbitration Association in Colorado. You agree to waive the right to a jury trial and agree that disputes will be resolved on an individual basis only, not as part of a class action.

IX. Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

X. Entire Agreement
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and True Care Behavior regarding use of our Services and supersedes any prior agreements or understandings.
By using our Services, you acknowledge that you understand and agree to these Terms of Use.
